I think it's a "House Spider" (Achaearanea tepidariorum), but let me check... _________________ "Tarantulas are friends, not food" (but I bet they taste pretty good with butter and lemon!)
The spider on the picture is an Araneidae while most of the pictures from the link Celeste provided were Theridiidae. I've personnaly never found an Araneidae inside a house or building . They would rather use door frames or window frames outside the house to build their webs. A Theridiidae will have no problem at all sneaking in and build a web inside the house ::lol:: or garage or mailbox :-)

It was found in the lower branches of a peach tree, with relatives living nearby in the aloe vera below.
If it helps, it does build an orbish web, where she attaches a line right in the middle and pulls it taunt towards her hide, IMO it allows her to be in the hide and "know" the moment anything lands on the web.
