As far as I know, fish and game will cite you for getting rattlesnakes without a fishing permit. I haven't seen anything in the code that excludes rattlesnakes from that list (although it may be buried in the legal-speak).
I'd say always have one, just in case, if you're collecting anything. Plus, even if you're out just for rattlesnakes, you might find something else you'd like to bag. For CA residents, the year fishing license isn't that bad anyway.
Also, there is a quota for how many rattle snakes you can collect, and your city/county may have rules on owning them.

from my understanding, from looking for bug regs in herp regs, any non-protected rattlesnake species native to CA is fair game to remove, destroy, or capture with no fishing license required.
also, you can catch snakes and lizards without a fishing lic. if you are under ~10 years old.... just like you can fish w/o a lic.
of course, as what pointed out... this only means you can catch a rattlesnake... it does not mean that there are no local level laws that prevent you from actually keeping the snake in captivity.
and the overwhelming odds are that you are not going to be able to find pertinent local laws online... and better than even odds if you called a local level gooberment official they will just tell you it is not legal out of hand.
this would probably be one of those things you would end up having to spend a couple thousand on hiring a lawyer or something to research for you.
Cloei and Andrew are right about NOT needing a permit to collect. However, I thought it was a good point to have one in case you find something cool you want to collect.
As far as keeping a rattler, you do have to check with the local county/city laws. I have no idea what OC allows but the city of Irvine does not allow any venomous animals to be kept.

hmmm... news to me about the rattlesnake exception. However, I will say that if you're road collecting rattle snakes w/o a permit and fish and game notices you, be prepared to possibly have your car searched as they look for non-rattlesnake herps. They may give you a hard time about it, saying you have intention to collect snakes without a license, or the officer may not know the exception, take your animals and cite you anyway. In which case, it would be a pain to clear everything up.
Also, as said, it sucks to find a two headed gopher, or a new color morph of rosy boa and not have the fishing license. (although, admittedly, if I saw either of those, I'd bag it license or no )
I always just get the yearly license and keep in in my car or wallet. It's one less thing to worry about.
